1. Acceptance of Terms
By renting shelf space from RackRandezvous Rentals ("we", "us", or "our") or by interacting with us via WhatsApp, you ("Client" or "you") agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services Provided
RackRandezvous Rentals provides short-term and medium-term rental of shelf, rack, and display space at our locations in Nairobi, Kenya. Our services include:
- Shelf and display unit rental by week or month.
- WhatsApp-based booking, communication, and customer support via the Meta (WhatsApp Business) platform.
- Assistance with product placement and display guidance where applicable.
3. Booking and Payment
- All bookings must be confirmed in writing via WhatsApp or email.
- Full payment is required before occupying your rented shelf space unless otherwise agreed in writing.
- Accepted payment methods: M-Pesa and bank transfer. Details will be provided upon booking.
- Rental fees are non-refundable once the rental period has commenced.
4. Rental Period and Renewal
- The rental period begins on the agreed start date and ends on the agreed end date.
- Renewals must be requested at least 48 hours before the end of the current rental period.
- We reserve the right to decline renewal at our discretion.
- If you do not renew, you must remove all products from your shelf by the end of your rental period. Items not removed may be stored at your risk and expense.
5. Client Responsibilities
As a client, you agree to:
- Only display legal products that comply with Kenyan law and regulations.
- Not display counterfeit, hazardous, perishable (without prior agreement), or prohibited goods.
- Keep your assigned shelf space clean and well-presented at all times.
- Not alter, damage, or attach permanent fixtures to the shelf or surrounding area.
- Ensure your products are adequately labelled with prices and your contact information.
- Notify us promptly of any damage to the shelf or surrounding area.
6. Liability
- RackRandezvous Rentals is not liable for loss, theft, or damage to products displayed on rented shelf space. Clients are advised to insure their goods.
- We are not liable for any loss of profit, business interruption, or indirect loss arising from the use of our premises or services.
- Our total liability to any client shall not exceed the rental fees paid for the current rental period.
7. WhatsApp Communication
By providing your phone number and messaging us on WhatsApp, you consent to receive business-related communications from RackRandezvous Rentals via WhatsApp, including booking confirmations, reminders, and promotional messages. You may opt out of promotional messages at any time by replying "STOP". Transactional and booking messages will continue as necessary to service your rental.
Our WhatsApp Business account is operated through the Meta (Facebook) Business Platform. By communicating with us on WhatsApp, you also agree to WhatsApp's Terms of Service.
8. Termination
We reserve the right to terminate your rental agreement immediately, without refund, if you:
- Breach any of these Terms of Service.
- Display prohibited or illegal products.
- Fail to make payment when due.
- Cause damage to our premises or harass our staff.
9. Intellectual Property
All content on this website, including the RackRandezvous Rentals name and logo, is our intellectual property and may not be reproduced without written permission.
10. Governing Law
These Terms of Service are governed by the laws of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
11. Changes to These Terms
We may update these Terms of Service at any time. We will notify you of material changes via WhatsApp. Continued use of our services after changes have been posted constitutes acceptance of the new terms.
